Use of the MyPaymart Platform/MyPaymart Services

Please read the following terms and conditions carefully before registering on, accessing, browsing, downloading or using the MyPaymart website located at myPaymart.com, and all associated sites linked to myPaymart.com, or the MyPaymart mobile application or any similar platform (hereinafter collectively, the MyPaymart Platform run by Paymart India Pvt. Limited, having its registered office at SF-20, 2nd Floor, City Emporium Mall, Industrial Area, Phase-1, Chandigarh - 160002 and/or any of its affiliates (hereinafter collectively, Paymart or MyPaymart ) on any device and/or before availing any services offered by MyPaymart on the MyPaymart Platform which may include services such as customer or merchant payments, recharge or bill payment, digital service products, or marketplace service or any other service that may be offered by MyPaymart on the MyPaymart Platform (hereinafter individually, and collectively, the MyPaymart Services). For the avoidance of doubt, it is clarified that these terms and conditions shall apply to all MyPaymart Services, whether offered by Paymart India or its affiliates.

Communication Policy

By accepting the T&Cs, you accept the following:

• MyPaymart may send alerts to the mobile phone number provided by you while registering with the MyPaymart Platform for the SSOID service or on any updated mobile number subsequently provided by you on the MyPaymart Platform, or via e-mail or push notifications. The alerts will be received in case of SMS, only if the mobile phone is in ‘On’ mode to receive the SMS, in case of e-mail, only if the e-mail servers and e-mail ids are functional, and in case of push notifications, if the user has enabled the receipt of such notifications. If the mobile phone is in ‘Off’ mode or if the e-mail servers or ids are not functional or if the push-notifications feature has been turned off, then you may not get the alert at all or get delayed messages.

• MyPaymart will make best efforts to provide alerts via SMS/e-mail/push notifications and it shall be deemed that you shall have received the information sent from MyPaymart as an alert on the mobile phone number or e-mail id provided during the course of, or in relation to, using the MyPaymart Platform or availing any MyPaymart Services. MyPaymart shall not be under any obligation to confirm the authenticity of the person(s) receiving the alert. You cannot hold MyPaymart liable for non-availability of the SMS/email alert/push notifications service in any manner whatsoever.

• The SMS/e-mail alert/push notification service provided by MyPaymart is an additional facility provided for your convenience and that it may be susceptible to error, omission and/or inaccuracy. In the event that you observe any error in the information provided in the alert, MyPaymart shall be immediately informed about the same by you and MyPaymart will make best possible efforts to rectify the error as early as possible. You shall not hold MyPaymart liable for any loss, damages, claim, expense including legal cost that may be incurred/suffered by you on account of the SMS/e-mail alert/push notification facility.

• The clarity, readability, accuracy and promptness of providing the SMS/e-mail alert/push notification service depend on many factors including the infrastructure and connectivity of the service provider. MyPaymart shall not be responsible for any non-delivery, delayed delivery or distortion of the alert in any way whatsoever.

• You will indemnify and hold harmless MyPaymart and the SMS/e-mail service provider including its officials from any damages, claims, demands, proceedings, losses, costs, charges and expenses whatsoever including legal charges and attorney’s fees which MyPaymart or the SMS/e-mail service provider may at any time incur, sustain, suffer or be subjected to as a consequence of, or arising out of, any of the following: (i) misuse by you or improper or fraudulent information provided by you; (ii) incorrect number or a number that belongs to an unrelated third party provided by you; and/or (iii) the customer receiving any message relating to the reservation number, travel itinerary information, booking confirmation, modification to a ticket, cancellation of ticket, change in bus schedule, delay, and/or rescheduling from MyPaymart and/or the SMS/e-mail service provider.

• You will receive information via SMS, e mail and phone call regarding what MyPaymart perceive to be of your interest based on your usage history and browsing history (which information may be shared by Paymart India with its affiliates). This includes providing information relating to offers, discounts and general information by MyPaymart. In case you do not want such information, you have to explicitly ask to be excluded.

MyPaymart Payment Service Terms and Conditions

Please read the following terms and conditions carefully before registering on, accessing, browsing, downloading or using the MyPaymart website located at myPaymart.com, and all associated sites linked to myPaymart.com, or the MyPaymart mobile application or any similar platform (hereinafter collectively, the MyPaymart Platform) run by Paymart India Pvt. Ltd. SF 20, 2nd Floor, City Emporium Mall, Industrial Area, Phase 1, Chandigarh – 160002 and/ or any of its affiliates (hereinafter, collectively, Paymart India or MyPaymart) on any device and/or before availing any service that may be offered by MyPaymart on the MyPaymart Platform (hereinafter, individually MyPaymart Payment Service and collectively, the MyPaymart Payment Services).

Eligibility

The MyPaymart Payment Services are not available to persons under the age of 18 or to anyone previously suspended or removed by MyPaymart from availing the MyPaymart Payment Services or accessing the MyPaymart Platform. By accepting the T&Cs or by otherwise using the MyPaymart Payment Services on the MyPaymart Platform, you represent that you are at least 18 years of age and have not been previously suspended or removed by MyPaymart, or disqualified for any other reason, from availing the MyPaymart Payment Services or using the MyPaymart Platform. In addition, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all the T&Cs as part of this Agreement. Finally, you shall not impersonate any person or entity, or falsely state or otherwise misrepresent your identity, age or affiliation with any person or entity. Finally, in the event of any violation of the T&Cs, MyPaymart reserves the right to suspend or permanently prevent you from availing MyPaymart Payment Services or using the MyPaymart Platform.

General Terms and Conditions

The terms and conditions in relation to the payment services set out below are applicable to and binding on you in conjunction with all the terms and conditions already accepted by you. Each term or condition is applicable to and binding on you, or any of your activities on the MyPaymart Platform, even if such term or condition is not specifically reproduced herein below. The terms ‘Agreement’ or ‘T&Cs’ mentioned herein below includes the terms and conditions in relation to the payment service set out below and other service-specific terms and conditions in relation to MyPaymart Services or MyPaymart Platform.

PRIVACY POLICY

We Paymart India Pvt. Limited, having its registered office at SF 20, 2nd Floor, City Emporium Mall, Industrial Area, Phase 1, Chandigarh – 160001, hereinafter referred to as Paymart. At Paymart, we value your trust & respect your privacy. This Privacy Policy provides you with details about the manner in which your data is collected, stored & used by us. You are advised to read this Privacy Policy carefully. By visiting Paymart’s website/WAP site/applications you expressly give us consent to use & disclose your personal information in accordance with this Privacy Policy. If you do not agree to the terms of the policy, please do not use or access Paymart website, WAP site or mobile applications. Note: Our privacy policy may change at any time without prior notification. To make sure that you are aware of any changes, kindly review the policy periodically. This Privacy Policy shall apply uniformly to Paymart desktop website, Paymart mobile WAP site & Paymart mobile applications.

General

We will not sell, share or rent your personal information to any 3rd party or use your email address/mobile number for unsolicited emails and/or SMS. Any emails and/or SMS sent by Paymart will only be in connection with the provision of agreed services & products and this Privacy Policy. Periodically, we may reveal general statistical information about Paymart & its users, such as number of visitors, number and type of goods and services purchased, etc. We reserve the right to communicate your personal information to any third party that makes a legally-compliant request for its disclosure.

Personal Information

Personal Information means and includes all information that can be linked to a specific individual or to identify any individual, such as name, address, mailing address, telephone number, email ID, credit card number, cardholder name, card expiration date, information about your mobile phone, DTH service, data card, electricity connection, Smart Tags and any details that may have been voluntarily provide by the user in connection with availing any of the services on Paymart When you browse through Paymart, we may collect information regarding the domain and host from which you access the internet, the Internet Protocol [IP] address of the computer or Internet service provider [ISP] you are using, and anonymous site statistical data.

Use of Personal Information

We use personal information to provide you with services & products you explicitly requested for, to resolve disputes, troubleshoot concerns, help promote safe services, collect money, measure consumer interest in our services, inform you about offers, products, services, updates, customize your experience, detect & protect us against error, fraud and other criminal activity, enforce our terms and conditions, etc. We also use your contact information to send you offers based on your previous orders and interests. We may occasionally ask you to complete optional online surveys. These surveys may ask you for contact information and demographic information (like zip code, age, gender, etc.). We use this data to customize your experience at Paymart, providing you with content that we think you might be interested in and to display content according to your preferences.

Cookies

A "cookie" is a small piece of information stored by a web server on a web browser so it can be later read back from that browser. Paymart uses cookie and tracking technology depending on the features offered. No personal information will be collected via cookies and other tracking technology; however, if you previously provided personally identifiable information, cookies may be tied to such information. Aggregate cookie and tracking information may be shared with third parties.

Links to Other Sites

Our site links to other websites that may collect personally identifiable information about you. Paymart is not responsible for the privacy practices or the content of those linked websites.

Security

Paymart has stringent security measures in place to protect the loss, misuse, and alteration of the information under our control. Whenever you change or access your account information, we offer the use of a secure server. Once your information is in our possession we adhere to strict security guidelines, protecting it against unauthorized access.

Consent

By using Paymart and/or by providing your information, you consent to the collection and use of the information you disclose on Paymart in accordance with this Privacy Policy, including but not limited to your consent for sharing your information as per this privacy policy.

GREVIANCE POLICY

Paymart strongly believes in a sincere and transparent approach to its users. You trust and love us and we would never put growth before trust. This policy document aims at minimizing instances of customer complaints, grievances and disappointments via channelized approach, review and redressal. The self-review will be of help in identifying shortcomings in the product features and service delivery. If you’re disappointed, then at some point in time we’ve not done a great enough job. Paymart’s policy on grievance redressal follows the under noted principles.

• Our users are to be treated fairly at all times.

• Complaints or concerns raised by users are dealt with an open mind, with courtesy and in a timely manner.

• Users are informed about the channels to escalate their complaints, concerns and grievances within Paymart and their rights if they are not satisfied with the resolution of their complaints.

• Paymart will take care of all complaints efficiently and fairly as they value each user.

• All employees at Paymart must work in good faith and without prejudice to the interests of the users.

We understand that customer grievances can happen due to multiple reasons. It can be because of the gap between the promised service levels and the service levels actually offered. Since we are dealing with humans, a lot of grievances can arise due to the attitudinal and the way communication gets done. It can also happen due to the actual errors across the system. Users have complete authority to file a complaint/ share feedback if they are disappointed by services rendered by Paymart. They can give their complaint/ feedback in writing, email, or on myPaymart.com. If user’s dilemma is not resolved within the given time or if they are not satisfied with the solution provided by Paymart, they can approach our tiered redressal system with their complaint or other legal avenues available for grievance redressal. In order to make Paymart redressal channels more meaningful and effective, a structured system has been put in place. This system will ensure that the complaints are redressed seamlessly and well within the stipulated timeframe.

Awareness of Grievance Redressal System

At Paymart, the users' experience is what we deliberate and focus on. This is why we listen and take the time to know our users and take their concerns seriously. Going skin-deep to analyze and scrutinize, how you would feel from the time you step-in to Paytm.com till the time you’re done, helps us evolve and enhance our services. If a user has found our experience simple and incredible we know we are doing something worthy. However, when a user is concerned or has complaints we do everything we can to fix it and make it right.

Sensitizing staff on handling complaints

Our staff undergoes regular training to ensure that consumers queries and grievances are handled properly. They are encouraged to work in a manner which helps us in building the consumer trust and confidence. This reflects in both the operations as well as the customer communications. Top reasons behind the consumer queries are analysed and worked upon in a way which aims at removal of these reasons from the root. This helps in improving the overall quality of the service levels gradually.
